Terms of Service

Welcome to JMAX Technology Co., Ltd. These Terms of Service (“Terms”) govern your access to and use of our website, products, and procurement services. By placing an order with JMAX, you agree to be bound by these Terms.

1. Quotes and Orders

1.1 Quote Validity

Due to the volatile nature of the semiconductor market, price quotes provided by JMAX are valid for 3 business days unless otherwise stated in writing. We reserve the right to adjust prices after this period based on market fluctuations.

1.2 Order Acceptance

Your receipt of an order confirmation does not signify our acceptance of your order. JMAX reserves the right to accept or decline your order at any time after receipt for any reason, including but not limited to stock unavailability or pricing errors.

2. Pricing and Payment

• Currency: All prices are quoted in US Dollars (USD) unless otherwise agreed.
• Taxes & Duties: Prices exclude VAT, customs duties, tariffs, and other governmental charges. You are responsible for paying these charges upon the goods’ arrival in your country.
• Payment Methods: We accept T/T (Telegraphic Transfer/Bank Wire) for all orders. PayPal is accepted for sample orders under $1,000 USD (subject to a processing fee).

3. Shipping and Delivery

3.1 Incoterms

Unless otherwise specified in the Proforma Invoice (PI), all shipments are EXW (Ex Works) Shenzhen or FCA (Free Carrier) Hong Kong. Risk of loss passes to the buyer upon delivery to the carrier.

3.2 Delivery Timelines

Estimated delivery dates are provided for your convenience. JMAX is not liable for delays caused by customs clearance, carrier issues, or force majeure events.

4. Warranty Policy

We stand behind the quality of our hardware. Warranty terms depend on the product condition:

• New Retail / Factory Sealed: Covered by the original manufacturer’s warranty (e.g., Intel, Samsung, Dell). JMAX will assist in the RMA process where applicable.
• New Bulk / OEM: 1-Year JMAX Warranty.
• Refurbished / Used: 90-Day JMAX Warranty (unless extended warranty is purchased).

The warranty does not cover damage caused by misuse, improper installation, overclocking, or shipping damage not reported within 48 hours of receipt.

5. Returns and RMA

1. Inspection Period: You must inspect all goods within 3 business days of receipt. Discrepancies regarding quantity or physical damage must be reported immediately.
2. RMA Process: No returns are accepted without a Return Merchandise Authorization (RMA) number. Please contact support@jmaxserverchips.com to initiate a claim.
3. Non-Defective Returns: Returns of non-defective items are subject to a 20% restocking fee and must be returned in original condition. Custom-configured servers are non-returnable.

6. Limitation of Liability

To the maximum extent permitted by law, JMAX Technology Co., Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or goodwill, resulting from (i) your use of our products; or (ii) any failure of performance, error, omission, interruption, or defect.

In no event shall JMAX’s aggregate liability exceed the amount paid by you for the specific product giving rise to the claim.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People’s Republic of China. Any disputes arising out of these Terms shall be resolved through arbitration in Shenzhen, China.

8. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services constitutes acceptance of the revised Terms.
